These Terms of Service (“Terms”) govern your access to and use of the Torvi App messaging service, website, and related services (collectively, the “Service”), provided by Torvi App Ltd. or its affiliated entities (“Torvi,” “we,” “us,” or “our”).

By creating an account, downloading, accessing, or using the Service, you agree to be legally bound by these Terms. If you do not agree, you must not use the Service.

1. Eligibility and Account Registration

  1. You must be at least 13 years old to use the Service.
    If you are under 18, you confirm that you have permission from a parent or legal guardian.

  2. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

  3. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  4. You may not create more than one account for deceptive, abusive, or fraudulent purposes.

2. Description of the Service

Torvi App is a digital communication platform that enables users to exchange messages, media, files, voice messages, calls, and other content.

We do not guarantee uninterrupted or error-free operation of the Service and reserve the right to modify, suspend, or discontinue features at any time.

3. User Content and Responsibility

3.1 Ownership of Content

  • You retain ownership of all content you create, upload, send, or share (“User Content”).

  • By using the Service, you grant Torvi a limited, non-exclusive, worldwide license to process your content solely for the purpose of operating and improving the Service.

3.2 Responsibility

  • You are solely responsible for your User Content and for ensuring that it complies with these Terms and all applicable laws.

  • Torvi does not endorse, verify, or guarantee the accuracy or legality of User Content.

4. Prohibited Content and Conduct

You may not use Torvi App to create, upload, send, distribute, store, or promote any content or behavior that is illegal, harmful, or abusive.

4.1 Illegal Content (Strictly Prohibited)

The following content is strictly forbidden and may result in immediate account suspension or termination, as well as reporting to authorities:

  • Child sexual abuse material (CSAM) or any sexual content involving minors

  • Terrorist content, propaganda, recruitment, or praise of terrorist organizations

  • Human trafficking, sexual exploitation, or forced labor

  • Sale, distribution, or promotion of illegal drugs or controlled substances

  • Promotion or facilitation of violent crimes

  • Instructions for making weapons, explosives, or committing crimes

  • Fraud, scams, phishing, identity theft, or financial exploitation

  • Content that violates international sanctions or export control laws

4.2 Harmful or Abusive Content

You may not:

  • Harass, threaten, stalk, or intimidate others

  • Engage in hate speech or discrimination based on race, ethnicity, nationality, religion, gender, sexual orientation, disability, or other protected characteristics

  • Share non-consensual intimate images or “revenge porn”

  • Encourage self-harm or suicide

  • Engage in bullying or coordinated harassment

4.3 Misuse of the Platform

You may not:

  • Use bots, scrapers, or automated tools without authorization

  • Spam users or distribute unsolicited messages

  • Impersonate another person or organization

  • Interfere with the operation or security of the Service

  • Attempt to bypass safeguards, moderation systems, or access restrictions

5. Compliance with Laws (US & EU)

You agree to comply with all applicable local, national, and international laws, including but not limited to:

  • U.S. federal and state laws

  • European Union laws and regulations (including the Digital Services Act (DSA))

  • Data protection laws such as the GDPR

  • Intellectual property laws

  • Criminal and civil laws applicable to online communication

Torvi reserves the right to remove content, restrict access, or report users where legally required.

6. Moderation, Enforcement, and Sanctions

6.1 Enforcement Measures

If you violate these Terms, Torvi may take one or more of the following actions:

  • Remove or restrict access to specific content

  • Issue warnings

  • Temporarily suspend your account

  • Permanently terminate your account

  • Restrict features or communication capabilities

  • Report violations to law enforcement or regulatory authorities

6.2 No Circumvention

Attempts to evade enforcement (e.g., creating new accounts after a ban) are prohibited and may result in permanent exclusion.

7. Privacy and Data Protection

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect personal data.

Key principles:

  • We process personal data lawfully, transparently, and for legitimate purposes

  • Users have rights under GDPR (access, rectification, erasure, restriction, portability, and objection)

  • We implement appropriate technical and organizational security measures

8. Intellectual Property

All trademarks, logos, software, and platform designs associated with Torvi App are the exclusive property of Torvi or its licensors.

You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written permission.

9. Disclaimer of Warranties

To the maximum extent permitted by law, Torvi disclaims all warranties, including but not limited to:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Availability or reliability of the Service

10. Limitation of Liability

To the fullest extent permitted by applicable law:

  • Torvi shall not be liable for indirect, incidental, consequential, or punitive damages

  • Torvi is not liable for User Content or user conduct

  • Total liability shall not exceed the amount paid by you (if any) for using the Service in the preceding 12 months

Nothing in these Terms limits liability where such limitation is prohibited under EU or U.S. law.

11. Indemnification

You agree to indemnify and hold harmless Torvi, its affiliates, officers, employees, and partners from any claims, damages, losses, or expenses arising out of:

  • Your use of the Service

  • Your violation of these Terms

  • Your violation of applicable laws or third-party rights

12. Termination

You may terminate your account at any time.
Torvi may suspend or terminate your account with or without notice if you violate these Terms or if required by law.

Sections that by their nature should survive termination shall remain in effect.

13. Governing Law and Jurisdiction

  • For users in the European Union, these Terms are governed by the laws of the EU member state of your habitual residence, where mandatory consumer protections apply.

  • For users in the United States, these Terms are governed by the laws of the State of [Insert State], without regard to conflict-of-law principles.
