This Disclaimer applies to the use of Torvi App, including all software, services, websites, and related features (collectively, the “Service”), operated by Torvi App Ltd. (“Torvi,” “we,” “us,” or “our”).

By accessing or using the Service, you acknowledge and agree to this Disclaimer.

1. General Disclaimer

The Service is provided on an “AS IS” and “AS AVAILABLE” basis.

To the maximum extent permitted by applicable law, Torvi makes no representations or warranties of any kind, express or implied, regarding:

  • The availability, continuity, accuracy, or reliability of the Service

  • The security or confidentiality of communications

  • The preservation, storage, or deletion of data or messages

  • The behavior, identity, or legality of other users

  • The suitability of the Service for any particular purpose

Use of the Service is entirely at your own risk.

2. No Responsibility for User Content

Torvi App is a technical communication platform.

  • Torvi does not create, edit, endorse, monitor, or control user-generated content as a general practice

  • All messages, media, files, and communications are the sole responsibility of the user who creates or shares them

  • Torvi is not liable for the legality, accuracy, or consequences of user content

Torvi shall not be held responsible for damages or harm resulting from user communications, interactions, or shared content.

3. No Guarantee of Data Retention or Delivery

Torvi App does not guarantee:

  • That messages will be delivered, stored, or retained

  • That chat histories, private messages, or multimedia data will remain available

Data, including chat content, may be automatically deleted after 7–30 days, depending on server configuration, technical requirements, or test-phase conditions.

Torvi shall not be liable for data loss, deletion, corruption, or delayed delivery, regardless of cause.

4. Third-Party Services and Links

The Service may rely on or interact with third-party infrastructure, software, or services.

Torvi:

  • Does not control third-party services

  • Is not responsible for third-party outages, failures, or data practices

  • Does not assume liability for damages arising from third-party systems

Use of third-party services is subject to their own terms and policies.

5. Security Disclaimer

While Torvi implements reasonable technical and organizational security measures:

  • No system can be guaranteed to be 100% secure

  • Torvi does not warrant that the Service is free from vulnerabilities, hacking, or unauthorized access

To the extent permitted by law, Torvi is not liable for damages resulting from security breaches, cyberattacks, or unauthorized data access.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Torvi App Ltd., its affiliates, directors, employees, and partners shall not be liable for:

  • Indirect, incidental, consequential, special, or punitive damages

  • Loss of data, profits, revenue, business, or goodwill

  • Personal harm resulting from user interactions

  • Damages arising from use or inability to use the Service

If liability cannot be excluded under applicable law, Torvi’s total cumulative liability shall be limited to the amount paid by the user for the Service in the previous 12 months, or USD/EUR 100, whichever is lower.

7. No Professional Advice

Content or communications transmitted via Torvi App do not constitute legal, medical, financial, or professional advice.

Torvi is not responsible for actions taken based on information exchanged through the Service.

8. Indemnification

You agree to indemnify, defend, and hold harmless Torvi from any claims, damages, liabilities, losses, or expenses arising from:

  • Your use or misuse of the Service

  • Your violation of laws or third-party rights

  • Your content or conduct on the platform

9. Mandatory Legal Exceptions

Nothing in this Disclaimer excludes or limits liability for:

  • Intentional misconduct or gross negligence

  • Death or personal injury caused by negligence

  • Fraud or fraudulent misrepresentation

  • Any liability that cannot be excluded under applicable EU or U.S. law

Consumer rights under mandatory law remain unaffected.

10. Governing Law

  • For users in the European Union, this Disclaimer is subject to mandatory consumer protection laws of the user’s country of residence
